What Is Article 4 of the EU AI Act? AI Literacy Requirements Explained

Article 4 of the EU AI Act requires AI literacy for all deployers. Here's what it says, who it applies to, and what auditors will look for by August 2026.

Most of the early commentary around the EU AI Act has focused on the high-risk classifications in Article 6, the prohibited practices in Article 5, and the transparency obligations that affect general-purpose AI providers. Those provisions matter. But there is a quieter requirement that applies far more broadly — and it is already in force.

Article 4 of the AI Act establishes a universal AI literacy obligation. It applies to every provider and deployer of AI systems operating in the EU, regardless of the risk classification of the systems they use. Unlike the high-risk provisions, which phase in through 2027, Article 4 has been applicable since 2 February 2025. Enforcement mechanisms take effect in August 2026.

This article explains what Article 4 actually says, who it covers, what "sufficient" AI literacy means in practical terms, and what evidence your organisation should be building now.


What Article 4 Actually Says

The full text of Article 4 of Regulation (EU) 2024/1689 reads:

Article 4 — AI literacy

Providers and deployers of AI systems shall take measures to ensure, to the best extent possible, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used.

Three elements of this text deserve close attention.

First, the obligation extends to deployers, not just providers. A deployer is any organisation that uses an AI system under its authority — which includes companies that purchase AI-powered recruitment tools, customer service chatbots, credit scoring platforms, or workforce analytics software. You do not need to build AI to fall within scope. You only need to use it.

Second, the standard is proportionate, not absolute. The phrase "to the best extent possible" and the instruction to consider "technical knowledge, experience, education and training" signal that the legislator expects organisations to calibrate their approach. A logistics firm whose warehouse staff interact with an AI-driven inventory system is not expected to deliver the same training as a machine learning engineering team. But both are expected to deliver something.

Third, the scope of people covered is wider than employees alone. The phrase "staff and other persons dealing with the operation and use of AI systems on their behalf" captures contractors, temporary workers, consultants, and anyone else who interacts with AI systems as part of their work for the organisation.


Who Article 4 Applies To

The short answer: virtually every organisation operating in the EU that uses AI in any form.

This is not limited to technology companies. It is not limited to organisations that develop AI models. It applies to deployers — and in 2026, that means most medium and large enterprises across every sector.

Consider what counts as an AI system under the Act's definition. Regulation (EU) 2024/1689 defines an AI system as:

a machine-based system that is designed to operate with varying levels of autonomy and that may exhibit adaptiveness after deployment and that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments.

That definition captures recruitment screening tools, automated content moderation, predictive maintenance platforms, AI-assisted medical diagnostics, chatbots, recommendation engines, fraud detection systems, and most implementations of large language models in business processes. If your organisation uses any of these — even as a customer of a third-party vendor — Article 4 applies to you as a deployer.

The people who need training are not just those in IT or data science roles. They include:

  • HR teams using AI-assisted recruitment or performance management tools
  • Customer service staff working alongside AI chatbots or sentiment analysis systems
  • Finance teams using AI-powered forecasting, risk scoring, or fraud detection
  • Marketing teams using AI for content generation, audience segmentation, or ad targeting
  • Managers and team leads who oversee processes where AI outputs inform decisions
  • Procurement officers who evaluate and purchase AI-powered software
  • Board members and senior executives who approve AI deployment strategies

The obligation is not to make everyone an AI expert. It is to ensure that every person who interacts with an AI system understands enough about how it works, what its limitations are, and what their responsibilities are when using it.


What "Sufficient AI Literacy" Means

The Act does not define a specific curriculum. It does not mandate a particular number of training hours. It does not require employees to pass a certification exam. Instead, it sets a functional standard: people must have a "sufficient level of AI literacy" to use AI systems responsibly in their specific role.

The European Commission's guidance and the preparatory documents from the AI Office point toward several competency areas that "sufficient" literacy should cover.

Understanding what AI does and does not do. Staff should understand that AI systems generate outputs based on patterns in data, not through reasoning or comprehension. They should know that AI outputs can be wrong, biased, or misleading — and that a confident-sounding output is not necessarily a correct one.

Recognising the limitations of the specific systems they use. A recruitment officer using an AI screening tool should understand what factors the tool considers, what it does not consider, what kinds of bias it might exhibit, and when human review is required. A customer service agent working with a chatbot should know when to escalate rather than trust the AI's response.

Knowing the organisation's policies for AI use. This includes acceptable use policies, data handling requirements, escalation procedures, and reporting obligations when AI systems produce unexpected or harmful outputs.

Understanding the regulatory context. Staff do not need to be lawyers, but they should know that AI use in the EU is regulated, that their organisation has compliance obligations, and that misuse of AI systems can have legal and ethical consequences.

Awareness of rights of affected persons. For systems that affect individuals — recruitment AI, credit scoring, public service delivery — staff should understand that those individuals have rights, including the right to know that AI is being used and, in some cases, the right to human review of automated decisions.

The proportionality principle means you should calibrate depth to role. A board member needs strategic literacy: governance, risk, oversight responsibilities. A front-line worker using an AI scheduling tool needs operational literacy: what the tool does, when to question its outputs, how to report problems. A data science team needs technical literacy that goes deeper into model behaviour, bias detection, and validation.


What Auditors Will Look For

Article 4 does not exist in isolation. It sits within a regulatory framework that includes market surveillance authorities, the AI Office, and — for high-risk systems — conformity assessment procedures. When enforcement begins in earnest, supervisory authorities will need to assess whether organisations have met their AI literacy obligations.

Based on the Act's text, European Commission guidance, and the precedent set by enforcement of comparable EU obligations (GDPR's accountability principle, NIS2's management training requirements), auditors are likely to look for several categories of evidence.

A documented training programme. Not a one-off awareness email, but a structured programme that identifies which roles interact with AI systems, what level of literacy each role requires, and how training is delivered. This should be proportionate — the Act does not expect identical training for all staff — but it should be systematic.

Training records and completion data. Auditors will expect to see who completed training, when they completed it, and what content they covered. This is the same evidentiary standard that applies to GDPR awareness training, workplace health and safety training, and financial crime compliance training. If you cannot prove it happened, it did not happen.

Role-specific content. Generic "introduction to AI" training may satisfy the requirement for some roles, but not for staff who interact with high-risk systems. An organisation deploying AI in recruitment should be able to demonstrate that its HR team received training specific to the risks and obligations associated with employment AI, not just a general overview of how large language models work.

Regular refresh and updates. AI technology evolves rapidly. A training programme completed in 2025 and never updated will not demonstrate ongoing compliance in 2027. Auditors will look for evidence that training content is reviewed and refreshed, particularly when the organisation adopts new AI systems or when regulatory guidance changes.

Assessment of effectiveness. The strongest compliance posture includes some form of assessment — scenario-based evaluations, knowledge checks, or practical exercises — that demonstrates staff did not merely complete training but actually absorbed its content. This is where scenario-based training provides a significant advantage over slide-based alternatives: it generates evidence of applied understanding, not just attendance.

An AI literacy policy. A written policy that sets out the organisation's approach to AI literacy, identifies the roles and functions covered, assigns responsibility for delivery and maintenance, and connects to the broader AI governance framework. This does not need to be a hundred-page document. A clear, concise policy that demonstrates the organisation has thought through its approach is sufficient.


The Enforcement Timeline

The timeline for AI Act enforcement is staggered, but Article 4 is near the front of the queue.

  • 2 February 2025: Article 4 (AI literacy) and Article 5 (prohibited practices) became applicable. Organisations are expected to be working toward compliance from this date.
  • 2 August 2025: Rules on general-purpose AI models become applicable.
  • 2 August 2026: The majority of AI Act provisions take effect, including the full enforcement framework for Article 4. Market surveillance authorities gain formal enforcement powers, and penalties become applicable.
  • 2 August 2027: Rules for high-risk AI systems listed in Annex I become applicable.

The practical implication: you have until August 2026 before enforcement authorities can formally act on Article 4 non-compliance. That sounds like time. It is less than it appears.

Building a proportionate AI literacy programme requires an AI systems audit (identifying what AI your organisation actually uses), a role mapping exercise (determining who interacts with those systems), content development or procurement, delivery logistics, and documentation infrastructure. For a mid-size enterprise, that is a six-to-nine-month project if approached thoroughly.

Organisations that have not started planning should be starting now. Those that have been working on it since early 2025 are in a much stronger position — and will find compliance a natural extension of work already underway, rather than a scramble before the deadline.


Building a Proportionate Programme

The most common mistake organisations make with Article 4 compliance is treating it as a single training event rather than an ongoing programme. The Act's language — "take measures to ensure" a sufficient level of literacy — implies a continuous obligation, not a one-time delivery.

A proportionate programme typically has four layers.

Layer 1: Organisation-wide foundation. Every employee receives a baseline introduction to AI: what it is, how it is used in the organisation, what the AI Act requires, and what the organisation's AI use policies are. This layer is broad and relatively lightweight — 30 to 60 minutes of content, refreshed annually.

Layer 2: Role-specific depth. Staff who interact directly with AI systems receive additional training tailored to the systems they use. For HR teams using AI recruitment tools, this covers bias risks, human oversight requirements, and candidate rights. For finance teams using AI forecasting, it covers model limitations and decision accountability. This layer is where the proportionality principle matters most.

Layer 3: High-risk system training. Staff involved in deploying, monitoring, or overseeing high-risk AI systems (as classified under Article 6) receive detailed training on the specific compliance obligations for those systems — including conformity assessment, fundamental rights impact assessments, and human oversight protocols.

Layer 4: Leadership and governance. Board members and senior executives receive training focused on AI governance, organisational liability, oversight responsibilities, and strategic risk. This aligns with the broader trend across EU regulation — NIS2, DORA, the Pay Transparency Directive — of placing compliance accountability at the governance level.

What Happens If You Do Nothing

The AI Act's penalty framework is significant. For breaches of Article 4, supervisory authorities can impose administrative fines of up to EUR 15 million or 3% of global annual turnover, whichever is higher. For SMEs and startups, the cap is the lower of those two figures.

But the more realistic risk for most organisations is not a maximum fine. It is the operational and reputational exposure of being unable to demonstrate compliance when asked — by a regulator, by a client conducting due diligence, by a prospective partner, or by an employee raising a concern about how AI is being used in their workplace.

The organisations that will navigate this well are not the ones that panic in mid-2026. They are the ones that treat Article 4 as what it is: a reasonable obligation to ensure that people who use AI understand what they are using. That is good practice regardless of regulation. The AI Act simply makes it a legal requirement.

Start with an audit of your AI systems. Map who uses them. Build training that is proportionate to role and risk. Document everything. Refresh it regularly. That is what Article 4 asks for — and it is achievable for any organisation that takes it seriously.
